The SFO's decision to seek permission for a judicial review of the decision of the Criminal Cases Review Commission to refer the cases of Lyons, Parnes, Ronson and Saunders to the Court of Appeal was made after careful consideration of the case of R v Kansal and the views expressed in that judgment. There are a number of issues which may arise in the appeal, including the powers of the CCRC to refer cases and the considerations the Commission has given to the case.
There is no intention to delay the Appeal rather to allow the Court to give guidance on the circumstances in which the Commission should refer cases following a change in the law such as the Human Rights Act 1998
